2019 HIPAA Update: Enforcing Privacy & Security Standards

Professor Tschider is the 2018-2019 Jaharis Faculty Fellow in Health Law and Intellectual Property. Her primary scholarship is in information privacy, cybersecurity law, and artificial intelligence, with a particular focus on the global health care industry. Professor Tschider is also an expert in intellectual property and licensing, food and drug law, and contracts. Coming to DePaul Law from Mitchell Hamline School of Law in Minnesota, Professor Tschider has written or spoken on topics ranging from data collection in the medical industry and internet privacy to global data protection laws, amongst others.

Professor Tschider is the author of International Cybersecurity and Privacy Law In Practice and her academic writing have appeared or are forthcoming in the Denver Law Review, the Annals of Health Law, the Journal of Law & Biosciences, and the ABA’s The Law of Artificial Intelligence and Smart Machines, amongst others. She has appeared on NPR’s All Things Considered and has been featured in a variety of news media publications, including The Hill. She is also a reviewer for the Journal of World Intellectual Property and the Oxford Journal of Cybersecurity.

In 2017, Professor Tschider was named a Fulbright Specialist in Cybersecurity and Privacy Law by the Fulbright Scholar Program. At DePaul, Professor Tschider will be working with both the Jaharis Health Law Institute and the Center for Intellectual Property Law & Information Technology (CIPLIT). She will also be teaching a course in food and drug law in the fall and a course on cybersecurity and privacy law in the health care industry in the spring.

Elizabeth has been a health law attorney for seventeen years and is currently Assistant General Counsel over Privacy and Data Use for Cigna/Express Scripts. Elizabeth’s specialty is HIPAA and other privacy laws, providing s legal advice on sophisticated use and disclosure issues and incident response. She holds the CIPP/US and CIPM certifications from the Internal Association of Privacy Professionals. Elizabeth also teaches Privacy and Information Security Law at the Missouri University of Science and Technology.

Tracy Berns is Vice President, Ethics and Compliance, of the Minimally Invasive Therapies Group of Medtronic plc. Tracy has worked at the company (first Tyco Healthcare, then Covidien, and now Medtronic) since 2005. She started at Tyco Healthcare as regulatory counsel and in 2010 took the role of Chief Compliance and Regulatory Counsel, in charge of company compliance programs globally and responsible for working with the corporate quality and regulatory groups on regulatory matters.

Prior to joining Medtronic, Tracy worked with a number of medical device firms in regulatory and legal capacities, including C.R. Bard, Inc., ABIOMED, Inc. and Thermo Fisher Scientific. In addition, Tracy served as a Senior Consultant with EXPERTech Associates and worked in private practice at law firms in Washington, DC specializing in FDA regulatory law.

Ms. Berns received her J.D. from Columbia University and her B.A. from Knox College.

With over 20 years of experience, Tami Horton has a rich background as a legal and business partner and advisor focused on healthcare compliance, regulatory law, and ethics. Tami most recently served as the Chief Compliance Counsel and Privacy Officer at Cancer Treatment Centers of America (CTCA), where she led the national compliance team.

Prior to joining CTCA, Tami served as General Counsel and Chief Privacy and Compliance Officer for Illinois Bone & Joint Institute (IBJI), one of the largest independent physician practices in the country, where she was responsible for establishing the legal and compliance departments. In that role, Tami led IBJI’s legal team in its successful participation as an early awardee in the CMS Bundled payment for Care Improvement Initiative Program.

Previously, she was an associate at Mayer Brown in Chicago. Tami is certified in Healthcare Compliance by the Health Care Compliance Association and is a frequent speaker about compliance related topics and value-based payment models. Tami earned a J.D. with Honors from The University of Chicago and a Bachelor’s Magna Cum Laude and with Honors from the University of Michigan. She is a member of Phi Beta Kappa.
