I Don't Have a Problem - Detection and Treatment of Substance Abuse

This panel of experienced attorneys and substance-abuse professionals will discuss
substance addiction and abuse in the legal profession. From alcohol to prescription and
street drugs, the panel will identify the variety of substances people abuse, as well as
common causative factors of abuse, with a focus on practitioners in the entertainment
industry. The panel will also discuss symptoms of abuse, consequences to the
individual, colleagues, clients and loved ones, and resources available to those coping
with substance problems.

Panelist
Biographies
Michael G. Gerner
Attorney
Michael G. Gerner's law office is in Beverly Hills, California. He specializes in legal
ethics and professional responsibilities. His law practice emphasizes defense of
attorneys and the representation of law students before the State Bar Court. He consults
with private and government attorneys on the subjects of legal ethics, professional
responsibilities and risk management.
Mr. Gerner was admitted to the California State Bar in 1975. He was a State Bar
prosecutor in the Office of the Chief Trial Counsel for twenty-one years, involved in the
investigation and prosecution of attorneys for misconduct, and litigated moral character
matters regarding law students seeking admission the bar. During the last twelve years
as an attorney for the State Bar, he was an Assistant Chief Trial Counsel, with
management responsibilities in the Office of the Chief Trial Counsel.
Since 1998, Mr. Gerner has been in private practice engaged in the defense of attorneys
accused of professional misconduct and law students seeking admission to the bar. He
is a frequent speaker on the subject of legal ethics and professional responsibilities.

Arthur Margolis

Margolis & Margolis LLP
Arthur Margolis is a partner in the Los Angeles law firm of Margolis & Margolis LLP.
The firm specializes in the area of attorney ethics and professional responsibility.
Arthur Margolis was admitted to the California Bar in 1973. Thereafter, he was a
prosecutor for the State Bar of California for thirteen years. During that time, he
investigated hundreds of complaints against attorneys, and prosecuted attorneys in
formal disciplinary proceedings at the trial level as well as before the State Bar's Review
Department. In addition to his trial calendar, he supervised other State Bar prosecutors.
Further, he represented the California State Bar in disciplinary proceedings before the
California Supreme Court. When he left the State Bar in December of 1986, he held the
title of Senior Trial Counsel.
After leaving the Bar, Arthur prosecuted two cases at the Bar's request. His present
practice consists almost entirely of defending attorney's in State Bar disciplinary
proceedings and serving as a consultant on issues of professional responsibility.
At the request of California State Senator Robert Presley, Arthur assisted in the
formulation of legislation which significantly changed the California Business and
Professions Code as to attorney discipline.
Arthur served as an expert witness on professional responsibility in federal and state
courts, and he has lectured on the subject at law schools and bar associations, including
numerous MCLE classes. He has also served as an expert consultant for the Los
Angeles County District Attorney's office.

Janis Thibault
Director of the Lawyer Assistance
State Bar of California
Janis R. Thibault is the Director of the Lawyer Assistance Program of the State Bar of
California. She has been a Licensed Marriage and Family Therapist since 1979, is a
Certified Alcohol and Drug Abuse Counselor, and has worked in the field since 1985.
Prior to coming to the Bar in 2002, Janis worked in the Physician Diversion Program of
the Medical Board of California, eventually serving as the Program Manager. Prior to
her work with the Medical Board, Janis worked in private practice and in substance
abuse and psychiatric treatment.

Patricia Tierney
Attorney
Patricia Tierney is an attorney and a Peer Consultant for the Lawyers Assistance
Program (VI\P), where she counsels a confidential network of lawyers, judges and law
students seeking to educate and assist the legal profession when substance abuse
becomes a problem. She provides confidential consulting with attorneys and judicial
officers with alcohol and/or chemical dependency problems. Prior to joining LAP, Ms.
Tierney was a consultant for The Other Bar.
